General Terms and Conditions PAPATJA

These general terms and conditions apply to all orders placed via papatja.com and the related language pages of PAPATJA.

 

Article 1. Definitions

In these general terms and conditions, the following definitions apply:

PAPATJA
The entrepreneur who sells cotton bags with texts via the webshop.

Customer
The consumer or business customer who places an order via the webshop.

Webshop
The online store of PAPATJA, accessible via papatja.com and the related language pages.

Product
A cotton PAPATJA bag with text, as offered in the webshop.

Order
The agreement that is concluded when the customer orders and pays for a product via the webshop.

Cooling off period
The period of 14 days during which the consumer may exercise the right of withdrawal.

Right of withdrawal
The right of the consumer to cancel and return the order within the statutory cooling off period without giving any reason, insofar as this right applies.

 

Article 2. Identity of the entrepreneur

PAPATJA is established in the Netherlands.

 

Article 3. Applicability

These general terms and conditions apply to every offer made by PAPATJA and to every order placed via the webshop.

By placing an order, the customer agrees to these general terms and conditions.

Before the order is completed, these general terms and conditions are made available digitally.

If any provision of these general terms and conditions proves to be invalid, the remaining provisions will remain fully in force.

 

Article 4. The offer

PAPATJA sells cotton bags with texts. The texts may be recognizable, funny, inspiring or personally meaningful.

PAPATJA does its best to describe and display the products as clearly as possible. Images, colors, dimensions and details may differ slightly from the actual product. This may be due to, among other things, screen settings, lighting or small production margins.

Obvious mistakes or errors in the offer, such as clear pricing errors or typing errors, do not bind PAPATJA.

All prices in the webshop include VAT, unless stated otherwise.

Shipping costs are calculated separately during checkout. The shipping costs depend on the country to which the order is being sent.

 

Article 5. The agreement

The agreement is concluded when the customer places the order, completes the payment step and PAPATJA confirms the order by email. Please also check your spam folder if you have not received confirmation of your order within one hour.

PAPATJA may refuse or cancel an order if there is a valid reason to do so. For example, if there is a clear error in the offer, a payment issue, misuse of the webshop or an incorrect delivery address. If payment has already been made, the amount will be refunded.

The customer is responsible for checking the order before payment is made. This includes, among other things, the chosen product, the chosen text, the number of products, the delivery address and the contact details.

 

Article 6. Products and production

PAPATJA bags are carefully selected and printed. Many PAPATJA bags are printed with the chosen text only after the order has been placed.

Because the bag is processed after the order has been placed, an order can no longer always be changed or cancelled once production has started.

If the customer wants to change or cancel an order, the customer must contact PAPATJA as soon as possible via the contact page. PAPATJA will then check what is still possible.

If the bag has already been printed or shipped, the order can no longer be changed or cancelled.

 

Article 7. Payment

The available payment methods are shown during checkout.

The order will only be processed after the payment has been completed successfully.

Payment after delivery and ordering on account are not possible at this time.

After placing the order, the customer receives a confirmation by email with the order details.

The customer is responsible for correctly entering and checking payment details, invoice details and contact details.

 

Article 8. Shipping costs

The shipping costs are at the customer’s expense.

The amount of the shipping costs depends on the delivery country and is shown during checkout after the delivery address has been entered.

PAPATJA ships from the Netherlands to EU countries that are available in the webshop.

If a country is not available during checkout, PAPATJA cannot ship the order to that country at that time.

 

Article 9. Delivery

The place of delivery is the delivery address provided by the customer during checkout.

PAPATJA does not deliver to PO box addresses. The customer must always provide a complete home address or business address.

The delivery time may vary by country. Because many bags are printed only after the order has been placed, delivery may take longer than for a product that is shipped directly from stock.

PAPATJA aims to process and ship orders as quickly as possible. The maximum delivery period is 30 days, often within 10 working days.

If an order is delayed or cannot be delivered, PAPATJA will inform the customer.

The risk of damage to or loss of the product remains with PAPATJA until the product has been delivered to the customer or to a recipient designated by the customer.

 

Article 10. Gifts and delivery to another recipient

The customer can have a PAPATJA bag sent directly to someone else as a gift.

In that case, the customer enters the recipient’s address as the delivery address during checkout.

The customer is responsible for correctly entering the name and address of the recipient.

PAPATJA does not include an invoice with prices in the package, unless stated otherwise.

If the customer wants to add a personal message, this is only possible when this option is available during the ordering process.

 

Article 11. Right of withdrawal

A consumer has the right to withdraw from the order within 14 days after receipt without giving any reason, insofar as the right of withdrawal legally applies.

The cooling off period starts on the day after the customer, or a third party designated by the customer, has received the product.

To exercise the right of withdrawal, the consumer must inform PAPATJA within the cooling off period that he or she wishes to withdraw from the order. This can be done via the contact page, by email or by using the model withdrawal form.

After registering the return, the customer must send the product back as soon as possible, but no later than 14 days after the return notification.

 

Article 12. Return conditions

A return is only accepted if the product is unused, clean, unwashed, undamaged, in good condition and the label is still attached.

The customer may inspect the product as would be possible in a shop. The customer may not use the product in a way that goes beyond what is necessary to assess the nature, characteristics and functioning of the product.

If a product is returned used, washed, damaged, dirty or incomplete, PAPATJA may charge depreciation or refuse the return.

Bags that have been washed, bags that have shrunk, bags damaged by incorrect use or bags damaged by incorrect washing instructions cannot be returned on the basis of the right of withdrawal.

 

Article 13. Return costs

The costs of returning a product are at the customer’s expense, unless PAPATJA has delivered the wrong product or the product arrived damaged.

The customer is responsible for the return shipment until it has been received by PAPATJA.

PAPATJA advises the customer to keep the proof of shipment for the return.

If a return shipment is lost or damaged during return shipping, this risk lies with the customer, unless PAPATJA has offered a return method under which something else has been agreed.

 

Article 14. Refunds for returns

If the customer returns the full order within the conditions of the right of withdrawal, PAPATJA will refund the purchase amount, including the standard shipping costs of the original order.

The costs of sending back the return shipment remain at the customer’s expense.

If the customer ordered multiple products and returns only part of the order, PAPATJA will only refund the purchase amount of the returned products. The original shipping costs will not be refunded.

PAPATJA will refund the customer using the same payment method used by the customer, unless the customer agrees to another refund method.

PAPATJA may wait with the refund until the product has been received or until the customer has shown that the product has been returned. The refund will be made within 10 working days after receipt of the product or products.

 

Article 15. Damaged or incorrectly delivered products

If a product arrives damaged or if the customer receives a different product than ordered, the customer must contact PAPATJA as soon as possible.

The customer is asked to send the order number, a clear description of the issue and photos of the product and packaging.

PAPATJA will review the notification and look for a suitable solution. Depending on the situation, this may be replacement, repair, a new shipment or a refund.

Damage caused by incorrect use, washing, drying, ironing or normal wear and tear is not considered a fault of PAPATJA.

 

Article 16. Washing instructions and use

PAPATJA bags are made of cotton. Cotton may shrink slightly when washed. This is not a reason to return the bag.

PAPATJA recommends washing the bag by hand. If the customer still chooses to use a washing machine, PAPATJA recommends a short program at 30 degrees.

The bag must not be put in the dryer.

The customer must not iron directly over the print. If ironing is necessary, the bag must be turned inside out and ironed at a low temperature.

PAPATJA is not liable for damage, shrinkage or loss of quality caused by incorrect washing, drying, ironing or use.

 

Article 17. Guarantee and conformity

PAPATJA guarantees that the products comply with the agreement, the description in the webshop and the reasonable expectations the customer may have of the product.

The customer’s statutory guarantee rights always remain in force.

Small differences in color, size, fabric, finish or position of the print may occur and do not constitute a defect if these differences are reasonable and do not affect the normal use of the product.

If the customer believes that a product does not comply with the agreement, the customer must contact PAPATJA as soon as possible.

 

Article 18. Responsibility of the customer

The customer is responsible for correctly entering all details required for the order.

This includes, among other things, name, email address, delivery address, invoice details and any details of the recipient.

If an order cannot be delivered due to an error in the customer’s details, additional costs for a new shipment may be charged to the customer.

The customer is also responsible for carefully checking the chosen bag and text before placing the order.

 

Article 19. Intellectual property

All texts, designs, images, photos, product names, brand expressions, logos and other content on the webshop are the property of PAPATJA or are used with permission from the rights holder.

It is not permitted to copy, distribute, modify, sell, use for commercial purposes or publish PAPATJA content without prior written permission from PAPATJA.

The texts and designs on the bags are part of the PAPATJA collection. It is not permitted to reproduce or use them for personal products or sale without permission.

 

Article 20. Gift cards and discount codes

If PAPATJA offers gift cards, they can be used for purchases in the webshop.

A gift card is valid for one year after purchase.

A gift card cannot be exchanged for money.

A gift card cannot be used to purchase another gift card.

Discount codes can only be used within the validity period and according to the conditions of the relevant promotion.

A discount code cannot be applied afterwards to an order that has already been placed.

PAPATJA may change or end promotions, discount codes and conditions, as long as this does not negatively affect orders that have already been legally placed.

 

Article 21. Business and larger orders

Business customers can order via the webshop or contact PAPATJA for larger quantities.

For larger orders, for example orders from 10 pieces, PAPATJA may contact the customer before processing the order to confirm the quantity, delivery time and purpose of the order.

For business orders, additional agreements may apply, for example about quantities, delivery times, texts, invoicing, payment or returns.

Additional agreements are only valid if they have been confirmed in writing by PAPATJA.

The statutory right of withdrawal generally applies only to consumers and not to business customers.

For confirmed business orders, no right of withdrawal and no right of return applies, unless PAPATJA has delivered the wrong product or the product arrived damaged.

If a consumer places a larger order via the webshop, the statutory consumer rights remain in force.

 

Article 22. Privacy

PAPATJA processes personal data carefully and only insofar as this is necessary for, among other things, orders, payment, shipping, customer service, administration and marketing for which consent has been given.

Newsletter and marketing communication

Customers and visitors may choose to subscribe to the PAPATJA newsletter. Newsletter subscriptions are voluntary. By signing up, you agree to receive marketing emails from PAPATJA, such as updates about new designs, product inspiration, gift ideas and offers.

You can unsubscribe at any time by using the unsubscribe link in our emails. More information about how we process personal data for newsletters, email marketing, website analytics and order related communication can be found in our Privacy Policy.

 

Article 23. Complaints

If the customer has a complaint, the customer can contact PAPATJA via the contact page or the stated email address.

The customer is asked to include the order number and a clear description of the complaint.

PAPATJA tries to handle complaints as quickly as possible and to respond within 48 hours on working days at the latest.

If more time is needed to assess the complaint, PAPATJA will inform the customer.

 

Article 24. Force majeure

PAPATJA is not liable for delays or damage resulting from circumstances over which PAPATJA reasonably has no control.

This includes, among other things, disruptions at payment providers, disruptions at transport companies, strikes, illness, fire, extreme weather conditions, problems with suppliers, government measures or other situations of force majeure.

In the event of force majeure, PAPATJA will look for a suitable solution.

 

Article 25. Liability

PAPATJA is not liable for indirect damage, consequential damage or damage caused by incorrect use of the product.

The liability of PAPATJA is, insofar as legally permitted, limited to the amount the customer paid for the relevant order.

This limitation does not apply if the damage was caused by intent or deliberate recklessness on the part of PAPATJA.

 

Article 26. Applicable law

These general terms and conditions and all agreements between PAPATJA and the customer are governed by Dutch law.

If the customer is a consumer and lives in another EU country, the customer retains the protection of the mandatory consumer rules of the country where the customer lives, insofar as those rules apply.

Disputes will preferably first be resolved in mutual consultation.

If a dispute cannot be resolved in consultation, it may be submitted to the competent court in accordance with the law.
